Justinian Code subjects abortionists to the full penality of the civil and church law. And if people bring up about Theodora having abortions prior to meeting Justinian this was possbile but his law also stated that a husband could divorce a wife for having an abortion, so I doubt that she had an abortion after marrying him and she did ask the St Sabba to pray for her to conceive he refused since she was thought as a monophysite. Basil the first in the 9th century copied a lot of laws from Justinian and the laws against abortion and abandonment are also in his laws. The laws of Basil were completed by Leo VI. This is according to historian JD Bury an expert on the Latter Roman Empire-today known as the Byzantine empire. All of this is done by a study of laws by Calvinists not Orthodox. So, here is how Byzantine society thought on the issue of abortion which isn’t as important to modern orthodox.
