AOCA Verdict: Invalid, Inapplicable, Inconsistent, Ill-Advised

In a 15-page opinion offered to Metropolitan Philip, the Local Synod and the Board of Trustees of the Antiochian Archdiocese, dated May 13th, the Chancellors of the Archdiocese Robert Koory and Charles Ajalat shredded both the February 24th decision of the Synod of Antioch and the April 24th decision of the Local Synod as "invalid", "inapplicable" "inconsistent" and "ill-advised:"

…the February 24th decision is not a valid decision of the Holy Synod of Antioch. Moreover, even if were, it would have no effect on our Archdiocese since it wasn’t intend to apply to our Archdiocese and if it was intended, it would not apply because it is inconsistent with, negates, and would violate the irrevocable Resolution on Self-Rule, the Archdiocese Constitution and the Archdiocese Articles of Incorporation, filed with the State of New York.

Not only was the February 24 decision rejected, the Chancellors dismissed it as "folly". “Unless properly amended,” the Chancellors wrote:

…these documents cannot be overridden and the February 24,2009 decision is inapplicable to the Self-Ruled Archdiocese. Thus, what contradicts those articles in their application to North America is the Resolution of the Holy Synod granting self-rule, the Constitution of the Archdiocese of North America, the irrevocable creation of three diocesan bishops by the self-rule Resolution itself, the election and consecration of three bishops under the Constitution as diocesan bishops for North America and the enthronement of these various bishops their respective dioceses. To render all of these documents, resolutions and actions null and void by implication, or sub silentio, would be an absurd action. It cannot be imagined that the Holy Synod of Antioch, composed of wise and holy men, would participate in such a folly.

They further warned that all members of the Church bear the obligation to protect the Archdiocese Constitution:

Pursuant to the Constitution, all members of the Board of Trustees including the clergy and the hierarchs have an obligation to insure that the Archdiocese Constitution and Articles are protected. A constitution defines certain rights and privileges and obligations, these apply to the entire church population including the laity. It is incumbent upon all members to insure that these provisions are not violated even if one disagrees with them.

There is an element of trust that is underlying the role of a member of the Board of Trustees (and a member of the General Assembly) whether the person is a hierarch, priest, or member of the laity. That trust is that the member will act in the best interests of the Archdiocese and follow the dictates of the spirit as well as the letter of the Constitution. If the members do not act to protect the Constitution and the self-rule as defined therein, then they will have violated that trust. The consequences, among others, will be a legitimate lack of trust by clergy and laity in the leaders of this Archdiocese. That would be tragic.

It is given out at all meetings and sent to the mailing list of the organization. On the outside back cover is a statement entitled “Resolution for Autocephaly Adopted October 10, 1998,” in which an appeal is made to His All Holiness, Bartholomew, and to the SCOBA to further the “establishment of a united autocephalous Orthodox Church in America.”

A report from the regular session of the Synod of Bishops of the Russian Orthodox Church Outside of Russia, held May 5-7 in New York, discloses a plan to form a joint commission with the Orthodox Church in America to discuss issues that have kept the Churches apart. HT: Joe. The report says:

It was also decided to form a commission to study the relationship with the Orthodox Church in America and to hold joint meetings to discuss the sources of the division between the Russian Orthodox Church Outside of Russia and the American Metropoliate. Included in this commission are Bishop George, President; Archimandrite Luke (Murianka); Protopriest Alexander Lebedeff, Secretary; Protopriest David Moser and Priest Peter Jackson. The commission is to study and present findings on the reasons for the division and to evaluate the mutual accusations, and propose methods of healing the separation.

The Leadership of the Ecumenical Patriarchate and the Significance of Canon 28 of Chalcedon

The Ecumenical Patriarchate of Constantinople is the preeminent Church in the communion of the fourteen Autocephalous Orthodox Churches. Reflecting the witness of St. Andrew, the First Called Apostle, the enduring mission of the Ecumenical Patriarchate of Constantinople is to proclaim the salutary Gospel of Jesus Christ in accordance with the Apostolic and Orthodox Faith.

The Ecumenical Patriarchate has a particular responsibility to strengthen the unity of the Orthodox Churches and to coordinate their common witness. At the same time, the Ecumenical Patriarchate has a specific responsibility to care for the faithful in lands beyond the borders of the other Autocephalous Churches. This is a ministry of service to the entire Church which the Ecumenical Patriarchate undertakes in accordance with the canons and often under difficult circumstances.

The Faculty of Holy Cross Greek Orthodox School of Theology profoundly regrets that statements recently have been made which misinterpret the canonical prerogatives and distort historical facts related to the distinctive ministry of the Ecumenical Patriarchate. Indeed, some injudicious remarks have insulted the person of Ecumenical Patriarch Bartholomew and have attempted to diminish the significance of his ministry.

These statements, made by bishops, priests and laity, have been widely distributed. Regretfully, they have done little to advance the cause of Orthodox unity and the witness of the Church today. Indeed, some observations have misrepresented the traditional basis of Orthodox ecclesiology. They contradict the admonition of St. Paul that “all things should be done decently and in order” (1 Cor. 14:40).

Principles of Ecclesiastical Organization

The Church, chiefly through the Ecumenical Councils, has established significant principles of ecclesiastical organization. These principles are expressed in the canons of the Councils and in subsequent historical practices which have been sanctioned by the Church. These principles support the proclamation of the Gospel and strengthen the good order of the Church.

The Ecumenical Patriarch has been accorded specific prerogatives of witness and service from the time of the fourth century. This was a period when the Church was able explicitly to provide for canonical structures following the period of great persecution of the first three centuries. These prerogatives form the basis for his ministry to the entire Orthodox Church. These prerogatives distinguish the responsibilities of the Ecumenical Patriarch from other bishops of the Orthodox Church. They clearly grant to the Ecumenical Patriarch of Constantinople a primacy among the bishops of the Church. This primacy of service brings with it significant authority and responsibilities. Orthodoxy today is at a crossroads in America and throughout the world, writes George C. Michalopulos in Canon 28 and Eastern Papalism: Cause or Effect? on the main page of AOI. One of the great challenges facing us is inter-Orthodox cooperation. Specifically, how are new mission fields identified? And how are they granted autocephaly? What is the purpose of the Ecumenical Patriarchate and by what authority does it claim primatial honors?

Michalopulos’ essay examines the primatial claims of the Church of Constantinople and specifically, Canon 28 of the Council of Chalcedon, which has become the proof-text of recent Constantinopolitan claims which have startled many in the Orthodox world.
