A claim filed against the Port Authority of New York and New Jersey by church leaders and the Greek Orthodox Archdiocese of America on Monday accused the agency, which is overseeing Ground Zero’s rebuilding, of engaging in “arrogance, bad faith and fraudulent conduct” and “shabby and unlawful treatment.”

Under state law, the church is required to file a notice of claim against the Port Authority for some of its claims, and wait 60 days before it can go to court, according to Mark. G. Cunha, a lawyer for the church.

In 2008, after years of discussions, the Port Authority and the church announced an agreement to rebuild the church, which was originally located on Cedar Street, on a nearby site on Liberty Street. As part of the deal, the Port Authority said it would pay $20 million toward the cost of the new church.

Former Gov. George Pataki joined NY-1 congressional hopeful George Demos and clergy at the former site of the St. Nicholas Greek Orthodox Church in an attempt to get stalled negotiations between the Port Authority and the church going again.

“I’m calling on the Port Authority officials to sit down with the church leadership,” Pataki said as he stood with Demos and Bishop Andonios of Phasiane.

“We must rebuild St. Nicholas and we must do it here at the World Trade Center site,” Pataki said. “It’s incredibly disappointing to me that almost nine years later, not only is it not underway, but there haven’t been negotiations between church officials and the Port Authority for over a year.”

Bishop Andonios said he is hopeful that with the help of Pataki and Demos, they can move talks forward on St. Nicholas: “It is a house of worship not simply for the Greek Orthodox community, but a monument to the 3,000 souls of all faiths that lost their lives [on September 11th],” he said.

Fr. Michael Oleska, dean of St. Innocent Orthodox Cathedral in Anchorage, Alaska, writes that self-governance of the church also has an important practical dimension: corrupt bishops can be removed through the combined action of priests and laity. Self-governance in other words provides an essential check and balance that is lacking in the monarchical model of the episcopacy that emerged under submission to the Ottomans on the Byzantine side, and under submission and dependency on the state on the Russian side.

The past leadership of the OCA invoked this putative authority to intimidate priests and laity who refused to accept the rampant corruption that afflicted the OCA. In the GOA, the monarchical model has been imposed in greater measure ever since the Bishops were elevated to Metropolitans and the dioceses began to function as fiefdoms of Constantinople. This late development has its committed defenders as well (see: GOA Deacon responds to Dn. Eric Wheeler) although the reasoning never seems to get past the finger-wagging at those who dare challenge the implicit notion that the Metropolitans are infallible.

Somewhere in these discussions about autocephaly we should consider honestly how the self-governance of the Orthodox Church in America has benefited Orthodox Christians on this continent: and we don’t have to look back too far.

Our tragic situation in Alaska was resolved when a few clergy on the Kuskokwim River appealed to the Holy Synod of the OCA to alleviate their plight, the unkindness and insensitivity of a ruling bishop who was treating them and their culture with pronounced disrespect, imposing on them, precisely, an alien so-called “Russian” identity and trying to mold and direct them toward becoming replica parishes of his own concept of a “Russian Orthodox” ideal. The Holy Synod hesitated. Then more clergy and eventually hundreds of laity united in “one heart and one mind” emphatically expressed their desire for an appropriate investigation of the situation. There were actually two such visits, two reports, the first prepared and presented by the Chancellor of the Church, which was never received or published as the Primate refused to accept it, and the second prepared by two members of the Holy Synod, which was accepted, resulting in the “retirement” of the Alaskan hierarch.

Read closely. What are the greatest fears? The autocephaly of the OCA (wild card) and the Ligonier Council (precedent). The times are changing folks. The lumbering bureaucratic structures that have sublimated the nascent creativity and energy of American Orthodoxy under the weight Old World self-interest might be loosing their grip. There is more anxiety here than is being revealed.

Nearly 60 hierarchs will descend on New York from May 26-28 for the first Assembly of Canonical Orthodox Bishops from the United States, Canada and Central America, under the chairmanship of Archbishop Demetrios of America, and the stage has been set for some clashes about the direction the church should take, and the role of self-rule of some. The Assembly will convene at the Helmsley Park Lane Hotel, and its expense will be assumed by the Greek Orthodox Archdiocese, through the Leadership 100 grant to the Office of Inter-Orthodox, Ecumenical and Interfaith Relations and other sources. The meeting is the result of the decision of the Fourth Pre-Conciliar Pan-Orthodox Conference, which met in Chambesy, Switzerland in June of 2009, and it is one of 12 that will be convened around the world in regions where there is no single Orthodox presence.

The Bishops of the Diaspora, living in the Diaspora and possessing parishes in multiple regions, will be members of the Episcopal Assemblies of 12 regions. At the center of the Assembly will be the issue of the Diaspora, meaning the existence of more than one Orthodox Bishop in the same place (city.) Also participating is the former Russian Metropolia, known today as OCA, which was given autocephaly in 1970 by the Patriarchate of Moscow. The National Herald has learned that that Ecumenical Patriarch Bartholomew had initially instructed Archbishop Demetrios not to invite the OCA, but Demetrios sent them invitations to attend. The Archbishop discussed the issue during his recent visit to the Phanar three weeks ago.

BOSTON- At 83 years old and beleaguered by a raft of questions about his ability to keep leading, Archbishop Demetrios may leave his position at the Archbishopric Throne of America, it emerged after intense discussions at the Ecumenical Patriarchate in Constantinople, where he traveled unannounced, as well as among prominent Greek-American leaders who want him retained. The National Herald was unable to reach him at press time.

Those familiar with the issue attribute the possible development to his age the constant accumulation of various unresolved problems under his tenure recently.

Sources said it was believed at the Patriarchate that these questions have stagnated the ecclesial life of the Archdiocese of America. TNH also has learned that a group of prominent Greek Americans do not agree with the possibility of Archbishop Demetrios leaving his post and threatened to stop all financial and other support to the Ecumenical Patriarchate if he does not stay.

The speculation about a possible exodus were re-enforced after his meeting with Prime Minister George Papandreou and the Deputy Minister of State Demetris Droutsas in Athens on April 27. The Archbishop’s statement to The National Herald after the meeting that he discussed “issues that concern him” intensified even more the reports his departure is being arranged, especially after his visit to Constantinople.
