And what is to be said about the canonical disorders that we’re up to our ears in over there?

The situation of all the Orthodox eparchies dependent on mother churches in North America is uncanonical. There is one Orthodox church in those lands whose situation is sound and canonical: the American Orthodox Church (OCA). This alone is independent and autocephalous and this is de-facto recognized by the other Orthodox eparchies. Its recognition, formal or implicit, by the eparchies depending on mother churches is clear and frank confirmation that the status of these eparchies is uncanonical and unsound. If these eparchies and mother churches on which they depend were to be logical with themselves and consistent with Orthodox ecclesiological and canonical thought, in the true sense of the word, then they would belong to the OCA or would at least enter into an understanding with it and the thorny crisis of the Orthodox presence there, theologically and canonically, would end. The simplest position and the most sound is for us to leave the Orthodox in North America to themselves and to encourage them to arrange their affairs themselves! We and the other mother churches are the ones who are complicating their affairs!

Pastoral Care and the Crisis of Power

In the See of Antioch, at the current time, there is a confrontation, a crisis of opinion, and painful consequences may follow. Are the bishops, within an eparchy that is headed by a patriarch or a metropolitan as an ecclesial administrative unit, bishops over a territory and a faithful people, or are they auxiliary bishops (asaqifa musa’idun)?

The traditional position, within the Orthodox ecclesiological framework, makes the bishops within a single eparchy brothers and the primate (mallak) of the eparchy first of all the first among equals and secondarily the head of a local council, governed by principles and canons and made up of the bishops of that eparchy. This assumes that each of them oversees a territory and a people. In principle, bishops are not titular or auxiliaries, dependent upon the metropolitan or the patriarch.

But, historical events came about in past eras that divided some bishops from their territories and their flocks, as happened in the Byzantine Empire after the fall of some of its regions to the Ottomans. It was hoped at the time that exiled or refugee bishops would return to their regions. However, matters became more complicated and situations worsened and such bishops found themselves permanently exiled from their flocks. Or, the dioceses which they had overseen in principle were emptied of their Orthodox people. Continue reading

THE ORTHODOX DIASPORA
Decision

The Fourth Pre-Conciliar Pan-Orthodox Conference was convened by His All Holiness Ecumenical Patriarch Bartholomew, with the consensus of Their Beatitudes the Primates of the Most Holy Orthodox Churches expressed during their Sacred Synaxis at the Phanar in October 2008. The Fourth Pre-Conciliar Pan-Orthodox Conference met at the Orthodox Center of Ecumenical Patriarchate in Chambésy, from 6 to 13 June 2009 under the chairmanship of His Eminence Metropolitan John of Pergamon, representative of the Ecumenical Patriarchate.

This Conference, to which all of the most holy Orthodox Autocephalous Churches were invited and were represented, studied the issue of the canonical organization of the Orthodox Diaspora. Pursuant to article 16 of the Rules of Pre-Conciliar Pan-Orthodox Conferences, this Conference discussed the relevant documents submitted in 1990 and 1993 by the Inter-Orthodox Preparatory Commission, amending and approving them as follows:

1. a) It is affirmed that is the common will of all of the most holy Orthodox Churches that the problem of the Orthodox Diaspora be resolved as quickly as possible, and that it be organized in accordance with Orthodox ecclesiology, and the canonical tradition and practice of the Orthodox Church.

b) Likewise, it is affirmed that during the present phase it is not possible, for historical and pastoral reasons, for an immediate transition to the strictly canonical order of the Church on this issue, that is, the existence of only one bishop in the same place. For this reason, the Conference came to the decision to propose the creation of a temporary situation that will prepare the ground for a strictly canonical solution of the problem, based on the principles and guidelines set out below. Of necessity, this preparation will not extend beyond the convening of the future Great and Holy Council of the Orthodox Church, so that it (the Council) can proceed with a canonical solution of the problem.

2. a) This Conference proposes that, for the transitional period where the canonical solution of the issue will be prepared, “Episcopal Assemblies” of all canonically recognized bishops in each region should be created (or founded) in each of the regions defined below. The bishops will continue to be subject to the same canonical jurisdictions to which they are subject today.

b) These Assemblies will consist of all the bishops in each region who are in canonical communion with all of the most holy Orthodox Churches, and will be chaired by the first among the prelates of the Church of Constantinople and, in the absence of thereof, in accordance with the order of the Diptychs. These Assemblies will have an Executive Committee composed of the first hierarchs of the different jurisdictions that exist in the region.

c) The work and the responsibility of these Episcopal Assemblies will be the concern for manifesting the unity of Orthodoxy, the development of common action of all the Orthodox of each region to address the pastoral needs of Orthodox living in the region, a common representation of all Orthodox vis-à-vis other faiths and the wider society in the region, the cultivation of theological scholarship and ecclesiastical education, etc. Decisions on these subjects will be taken by consensus of the Churches who are represented in the particular Assembly. The Moscow Patriarchate has released a statement, in English, on the work of the all-Orthodox pre-conciliar meeting in Chambesy, Switzerland, earlier this month. The patriarchate explains how “episcopal assemblies” are to be constituted.

The 4th Pan-Orthodox Pre-Council Conference, which took place at the Patriarchate of Constantinople’s Orthodox Center in Chambesy near Geneva, completed its work on 12 June 2009. The delegation of the Russian Orthodox Church led by Archpriest Hilarion of Volokolamsk, chairman of the Moscow Patriarchate’s department for external church relations, included Archbishop Mark of Berlin, Germany and Great Britain, Russian Church Outside Russia, Archpriest Nikolay Balashov, DECR vice-chairman, and Mr. A. Churyakov, an interpreter.

The conference was chaired by Metropolitan John of Pergamon. Metropolitan Jeremiah of Switzerland, Patriarchate of Constantinople, acted as its secretary. It was attended by delegations of the Patriarchates of Constantinople, Alexandria, Antioch, Jerusalem, Georgia, Serbia, Romania and Bulgaria as well as Orthodox Churches of Cyprus, Greece, Albania, Poland, Czech Lands and Slovakia. They were led by their hierarchs.

His Holiness Patriarch Kirill of Moscow and All Russia addressed a message of greetings to the conference.

As had been agreed by primates and representatives of Local Orthodox Churches at their meeting in October 2008 at Fanar and reaffirmed by subsequent correspondence, the 4th Conference focused on the canonical order of the Orthodox diaspora. This decision on the agenda was made by the participants in the beginning of their work. The rest of the agenda items for Pan-Orthodox Pre-Council Conferences, including a procedure for declaring authocephaly and autonomy and the diptych order, will be considered in the sessions to follow the preparatory work to be done by the Inter-Orthodox Preparatory Commission.

The participants considered documents prepared by the Inter-Orthodox Preparatory Commission at its meetings on 10-17 November 1990 and 7-13 November 1993 and the conference of canon law experts which took place on 9-14 April 2009 in Chambesy. The documents were clarified and amended by consensus.

The conference agreed that the problem concerning the canonical order of the Orthodox diaspora, that is, those faithful who reside beyond the traditional boundaries of Local Orthodox Churches, should be dealt with on the basis of ecclesiology, canonical tradition and practice of the Orthodox Church. To this end, it was agreed to set up bishops’ assemblies consisting of all the canonical Orthodox bishops who take pastoral care of the community in a given locality. The task of bishops’ assemblies will be to ascertain and consolidate the unity of the Orthodox Church, to provide common pastoral care for Orthodox people in a region and to bear common witness before the external world. The assemblies’ decisions are to be made on the basis of consensus reached by the Churches whose bishops are represented in them. The authority of a bishops’ assembly exclude interference in the diocesan jurisdiction of each of the bishops and does not restrict the rights of his Church including in her relations with international organizations, governments, the civil society and mass media as well as other confessions, governmental and inter-confessional organizations and other religions.

The conference also adopted a revised draft procedure defining basically the work of regional bishops’ assemblies in the Orthodox diaspora.

On the Roman Catholic site AsiaNews, Nat da Polis files a report on the Fourth Pre-Conciliar meeting of Orthodox hierarchs who assembled last week in Switzerland to discuss the problem of the “diaspora.” Da Polis views the pending trip of Russian Orthodox Patriarch Kirill to the Ecumenical Patriarchate in Istanbul as a “significant step” in sorting out the disarray. Historic Orthodox decision, migrant communities to have their own bishops’ conferences

Istanbul (AsiaNews) – The first of two meetings scheduled for 2009 was held in Sabezy [Chambésy, Switzerland, ed.] to prepare the much awaited Pan-Orthodox Synod. In agreeing to set up Bishops’ Conferences for Orthodox Diaspora communities, the meeting reached a historic decision.

According to existing rules, Orthodox believers living outside their country of origin fall under the jurisdiction of the Ecumenical Patriarchate. However, the large-scale migration that followed the collapse of the Iron Curtain generated quite a few problems to those who are in charge of Orthodox life in the Diaspora because of the very close association of the Christian message to the ethnic origin of the faithful, a situation that has often been misunderstood or exploited with political and economic repercussions.

By a unanimous decision, Orthodox bishops’ conferences will be set up in the Diaspora and come under the chairmanship of the oldest metropolitan in Constantinople. If he is absent, then he will be replaced according to the canons of ecclesiology. The creation of new bishops’ conferences will thus reflect the new circumstances that have emerged in the Diasporic world.

All decisions will have to be based on the principle of unanimity of all Churches, each of which will be represented by their own bishops. Members in bishops’ conference will be bishops recognised by all Orthodox Churches. Constantinople will remain the coordinating centre for all the conferences.

A clear signal of the new situation came when it was reported that Kyrill, the new Patriarch of Moscow, will make his first foreign trip to Constantinople on 4 July.

The proceedings, chaired and skilfully directed by the Metropolitan of Pergamon Ioannis Ziziulas, [Metropolitan John (Zizioulas) of Pergamon, ed.] took place in a calm and constructive atmosphere, like never before, and were permeated by a desire to finally set a common path for Orthodoxy as a whole in the face of the challenges of today’s world. “Anti-monopoly” proposals of the Moscow Patriarchate are taken into account in Chambesy

Moscow, June 15, Interfax – The Fourth Pan-Orthodox Pre-Council Conference in Chambesy (Switzerland) has agreed in its final decision to the need of equal management of the Orthodox Diaspora which was highlighted by the representatives of the Moscow Patriarchate before the meeting.

The Conference decided to create new bishop assemblies within the regions of Diaspora (Orthodox communities living outside of the area of local Orthodox churches) to include all canonical Orthodox bishops governing the communities of such regions.

“The decisions by such bishop assemblies will be made in conformance with the consensus of the Churches represented therein. The powers of Episcopal assemblies neither allow the interference into the eparchial jurisdiction of each bishop, nor limit the rights of his Church,” the official website of the Moscow Patriarchate reports of the decisions of the Pan-Orthodox Pre-Council Conference.
